(a) By accessing this website and any of its associated websites or mobile applications (the “Site”), the user acknowledges these terms and conditions of use and agree to be bound by them. If the user does not agree to these terms, please discontinue accessing the Site immediately.

(b) The Program reserves the right, in its sole discretion, to modify, alter or otherwise update these terms and conditions at any time and the user agrees to be bound by such modifications, alterations or updates.

(c) The content of the Site is published by Kidsbury Daycare Ltd. (the “Program”) and its affiliates.

(d) The Program does not make any representations or warranties regarding the use, availability, access, performance, reliability, quality, security, privacy, or speed of the Site. The Site is provided on an “as is” and “as available basis”. The Program shall not be liable for any loss or damage resulting, directly or indirectly, from any use of the Site by the user, including those related to breaches of security, viruses, malicious code, or otherwise harmful content. The Site may, at times, not be accessible for various reasons, including system maintenance.

(e) By accessing the Site, the user agrees to indemnify and hold harmless the Program and its employees, contractors, agents, and volunteers from and against any and all actions, proceedings, costs, claims, liabilities, damages and expenses (including reasonable legal fees) arising from or in connection with a breach of these terms and conditions or the use of this Site.

(f) The contents of the Site are protected by applicable copyright and trademark laws. Unauthorized use or exploitation of such content is strictly prohibited including without limitation unauthorized downloading, retransmission, storage in any medium, copying, redistribution, reproduction, or republication of the Site, or any part thereof, for any purpose.

(g) Should the Site contain links, under no circumstances including but not limited to negligence shall the Program be liable for any direct, indirect, special, punitive, incidental, or consequential damages arising out of the use of or inability to use them. Further, the Program is not responsible for the content or the privacy practices of other links. The user is encouraged to examine each website's privacy policy and disclaimers to inform decisions regarding the accuracy, reliability and correctness of any materials located on those websites.

(h) The personal information a user provides through the Site is collected under the authority of the Early Learning and Child Care Act (ELCC) and is managed pursuant to the Freedom of Information and Protection of Privacy Act (FOIP).

(i) The Program cannot guarantee the complete confidentiality or security of information that is transmitted electronically. By accessing the Site, the user acknowledges that the Program is not responsible for any damages or losses the user may suffer as a result of their electronic transmission of confidential or sensitive information.

(j) The Program retains the right to monitor the Site and to disclose any information as necessary to:

 (i) satisfy any law, regulation or other governmental request;

 (ii) assist in the pursuit of any legal action or law enforcement activity;

 (iii) operate or improve the performance of the Site;

 (iv) ensure or enforce compliance with this agreement.

(k) These terms and conditions shall be governed and constructed in accordance with the laws of the Province of Alberta, and the laws of Canada applicable therein. If any provision of these terms and conditions is found to be unlawful, void, or for any reason unenforceable, then that provision shall be severed from the rest of these terms and conditions and shall not affect the validity and enforceability of any remaining provisions.
